Submitted September 23, 1977. Plaintiff McDonald & Co. initiated this action in the District Court, Yellowstone County, to recover damages for defendants' alleged breach of a real estate listing agreement. Defendants counterclaimed to recover damages purportedly caused by plaintiff's breach of a broker's fiduciary duty. The jury returned a verdict and judgment was entered awarding plaintiff damages in the sum of $11,830 and awarding defendants damages on their counterclaim in the sum of $10,000. Plaintiff filed an alternative motion to alter or amend the judgment. The District Court granted the motion and an amended judgment on the verdict was entered awarding plaintiff damages in the sum of $11,830 and awarding defendants damages on their counterclaim in the sum of $2,500.
